The Crux of the Lawsuit

The lawsuits said Xiaomi’s infringement started in late 2018 when it started to use the patented technology in its 4G smartphones.

The High Court of Delhi in India will now decide if Xiaomi violated patents of Sun Patent Trust and, further, if the patent owner has discharged its burden.

At the same time, the Paris Judicial Court will take up the critical question of royalty payments due to Sun Patent Trust for the said patented technology.

As per the report by FoneArena, Managing Trustee of Sun Patent Trust, said: “It is surprising that a company of Xiaomi’s standing is simply refusing to come to amicable terms at the negotiation table. Instead of engaging in meaningful negotiations, the company has been repeatedly trying to delay consummating a license. Patent law exists to protect and further substantial R&D investments, yet Xiaomi is frustrating this goal by failing to come to terms on a negotiated license. Regrettably, we must resort to such measures to compel Xiaomi to comply with international norms.”

A Long-Drawn Dispute

According to the Managing Trustee of Sun Patent Trust, Joseph Casino, it is surprising that Xiaomi is not willing to negotiate fair licensing terms despite attempts at resolution dating back to 2019.

While the patent owner is not known to be a litigious company, the response from Xiaomi has forced them to seek legal recourse.

There is a huge embarrassment for Xiaomi with these lawsuits—more so the one in the crucial Indian market.
